We are Charleston Riverfront Watersports ("Company," "we," "us," or "our"), a riverfront watersports and recreational services business.

We operate the website located at https://charlestonriverfrontwatersports.com/ and any related reservations, booking requests, waiver submissions, service inquiries, text message communications, and services that refer or link to these legal terms (collectively, the "Services").

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Charleston Riverfront Watersports, concerning your access to and use of the Services. By accessing the Services, requesting information, making a reservation inquiry, opting into text messages, booking a service, completing a waiver, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms and conditions or documents that may be posted on the Services from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms at any time and for any reason. We will update the "Last updated" date of these Legal Terms when changes are made. It is your responsibility to review these Legal Terms periodically to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Legal Terms by your continued use of the Services after the date such revised Legal Terms are posted.

1. OUR SERVICES

The information provided through the Services is for general informational and business purposes. Charleston Riverfront Watersports offers watersports rentals, recreational bookings, riverfront experiences, and related services depending on availability, safety conditions, and booking scope.

All services are subject to availability, property conditions, weather conditions, safety considerations, and our acceptance of the project. Any description of services on the Services is for general informational purposes only and does not constitute a binding offer.

Estimates or quotes provided through the Services, by phone, by email, or by text message are preliminary unless expressly stated otherwise in writing. Final pricing may vary based on booking duration, equipment or activity selected, group size, timing, river and weather conditions, safety considerations, requested add-ons, and other booking-specific factors.

2. INTELLECTUAL PROPERTY RIGHTS

Our intellectual property

We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, website designs, text, photographs, videos, graphics, logos, and trademarks contained in the Services (collectively, the "Content" and the "Marks").

The Content and Marks are protected by copyright, trademark, and other intellectual property laws. The Content and Marks are provided in or through the Services "AS IS" for your personal or internal business use only.

Your use of our Services

Subject to your compliance with these Legal Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use or internal business purposes.

Except as set out in this section or elsewhere in these Legal Terms, no part of the Services and no Content or Marks may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our prior written permission.

3. USER REPRESENTATIONS

By using the Services, you represent and warrant that:
  • you have the legal capacity and you agree to comply with these Legal Terms;
  • all registration, reservation request, waiver, contact, and opt-in information you submit will be true, accurate, current, and complete;
  • you will maintain the accuracy of such information and promptly update such information as necessary;
  • you will not access the Services through automated or non-human means unless specifically authorized by us;
  • you will not use the Services for any illegal or unauthorized purpose; and
  • your use of the Services will not violate any applicable law or regulation.
If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your use of the Services and refuse any and all current or future use of the Services.

4. PROHIBITED ACTIVITIES

You may not access or use the Services for any purpose other than that for which we make the Services available. As a user of the Services, you agree not to:
  • systematically retrieve data or other content from the Services to create a collection, compilation, database, or directory without our written permission;
  • trick, defraud, or mislead us or other users, especially in any attempt to learn sensitive information or gain unauthorized access;

  • disparage, tarnish, or otherwise harm, in our opinion, us and/or the Services through unlawful or abusive conduct;
  • use any information obtained from the Services to harass, abuse, or harm another person;
  • make improper use of our support services or submit false reports of abuse or misconduct;
  • use the Services in a manner inconsistent with any applicable laws or regulations;
  • engage in unauthorized framing of or linking to the Services;

  • attempt to impersonate another user or person or use false identifying information;

5. USER GENERATED CONTRIBUTIONS

The Services do not primarily offer users the ability to publicly post content. However, we may allow you to submit reviews, testimonials, comments, messages, photos, feedback, booking requests, waiver information, or other materials to us directly or through the Services (collectively, "Contributions").

Contributions may be viewable by us and, if you permit us to use them, may also be used in marketing materials, on our website, or on social media. By creating or making available any Contributions, you represent and warrant that:
  • you own or have the necessary rights and permissions to submit the Contributions;
  • the Contributions do not violate the privacy, publicity, copyright, trademark, or other rights of any third party;
  • the Contributions are not false, misleading, unlawful, defamatory, obscene, or otherwise objectionable; and
  • the Contributions do not contain malicious code, spam, or unauthorized advertising.

6. CONTRIBUTION LICENSE

By submitting any Contributions to us, you grant us a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, display, publish, distribute, and adapt such Contributions for the purpose of operating, marketing, advertising, and improving our business and Services, unless otherwise agreed in writing.

You retain ownership of your Contributions. However, you are solely responsible for the Contributions you submit and you expressly agree to reimburse us for any and all losses that we may suffer because of your breach of this section, your infringement of third-party rights, or your violation of applicable law.

7. SERVICES MANAGEMENT

We reserve the right, but not the obligation, to:
  • monitor the Services for violations of these Legal Terms;
  • take appropriate legal action against anyone who, in our sole discretion, violates the law or these Legal Terms;
  • refuse, restrict access to, limit the availability of, or disable any portion of the Services in our sole discretion and without notice;
  • remove from the Services or otherwise disable files and content that are excessive in size or burdensome to our systems; and
  • otherwise manage the Services in a manner designed to protect our rights and property and to facilitate the proper functioning of the Services.

8. TERM AND TERMINATION

These Legal Terms shall remain in full force and effect while you use the Services. WITHOUT LIMITING ANY OTHER PROVISION OF THESE LEGAL TERMS, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SERVICES TO ANY PERSON FOR ANY REASON OR FOR NO REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED IN THESE LEGAL TERMS OR OF ANY APPLICABLE LAW OR REGULATION.

We may terminate or suspend your use of the Services, your requests for service, or your communications with us at any time, without warning, in our sole discretion. If we terminate or suspend your use of the Services for any reason, you are prohibited from attempting to access the Services through any new or different identity or method.

9. MODIFICATIONS AND INTERRUPTIONS

We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason in our sole discretion without notice. We also reserve the right to modify or discontinue all or part of the Services without notice at any time.

We cannot guarantee the Services will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Services, resulting in interruptions, delays, or errors. We have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Services during any downtime or discontinuance.

10. GOVERNING LAW

These Legal Terms shall be governed by and defined following the laws of the State of West Virginia, without regard to its conflict of law principles.

11. DISPUTE RESOLUTION

Informal Negotiations

To expedite resolution and reduce the cost of any dispute, controversy, or claim related to these Legal Terms or the Services (each, a "Dispute"), the parties agree to first attempt to negotiate any Dispute informally for at least thirty (30) days before initiating legal action. Such informal negotiations commence upon written notice from one party to the other party.

Exclusive Venue

Any legal action arising out of or relating to these Legal Terms or the Services shall be brought exclusively in the state or federal courts located in or serving Kanawha County, West Virginia, and each party irrevocably consents to the jurisdiction of such courts.

Restrictions

To the fullest extent permitted by law, each party agrees that any Dispute shall be brought on an individual basis only and not as a plaintiff or class member in any purported class, consolidated, representative, or collective action.

12. CORRECTIONS

There may be information on the Services that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Services at any time, without prior notice.

13. DISCLAIMER

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We make no warranties or representations about the accuracy or completeness of the Services' content or the content of any websites or mobile applications linked to the Services. We assume no liability or responsibility for any errors, mistakes, inaccuracies, personal injury or property damage resulting from your access to and use of the Services, unauthorized access to or use of our secure servers and/or personal information stored therein, interruption or cessation of transmission to or from the Services, bugs, viruses, or the like, or any errors or omissions in any content.

Service availability and activity conditions may vary depending on weather, river levels, water conditions, equipment availability, staffing, safety concerns, and other site-specific factors. We do not guarantee that every requested booking, activity date, launch condition, or experience can be accommodated exactly as requested.

14. LIMITATIONS OF LIABILITY

IN NO EVENT WILL WE OR OUR OWNER, EMPLOYEES, AGENTS, CONTRACTORS, OR REPRESENTATIVES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Notwithstanding anything to the contrary contained herein, our total liability to you for any cause whatsoever and regardless of the form of the action shall at all times be limited to the amount paid, if any, by you to us for the specific service giving rise to the claim. If no amount was paid to us, our total liability shall not exceed one hundred U.S. dollars (US $100.00), to the fullest extent permitted by law.

15. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless, including our owner, employees, agents, contractors, and representatives, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of: (1) your use of the Services; (2) your breach of these Legal Terms; (3) your violation of the rights of a third party; or (4) any false, inaccurate, or misleading information provided by you.

16. USER DATA

We will maintain certain data that you transmit to the Services for the purpose of managing the performance of the Services, as well as data relating to your use of the Services. Although we perform routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Services. You agree that we shall have no liability to you for any loss or corruption of any such data.

17. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

Visiting the Services, sending us emails, submitting forms, requesting reservations, exchanging text messages, completing waivers, and completing bookings electronically constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, estimates, invoices, and other communications we provide to you electronically satisfy any legal requirement that such communication be in writing.

YOU HEREBY AGREE TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, ORDERS, AND OTHER RECORDS, AND TO ELECTRONIC DELIVERY OF NOTICES, POLICIES, AND RECORDS OF TRANSACTIONS INITIATED OR COMPLETED BY US OR VIA THE SERVICES.

18. MOBILE/SMS MESSAGING TERMS

Charleston Riverfront Watersports SMS Program

By providing your mobile phone number and opting in to receive text messages from Charleston Riverfront Watersports, you agree to receive SMS communications from us related to our Services. These messages may include booking follow-ups, scheduling communications, reservation confirmations, reservation reminders, service updates, customer care communications, and occasional promotional or marketing messages where you have consented to receive them.

Message frequency varies depending on your interaction with us, the Services you request, and your communication preferences.

You may opt out of our SMS program at any time by replying STOP to any text message we send you. After we process your opt-out request, you will no longer receive SMS messages from that program unless you opt in again.

If you previously opted out and would like to rejoin, you may opt in again through a website form, another consent method made available by us, or by contacting us directly at [email protected].

Standard message and data charges may apply to messages sent to you from us and to messages sent from you to us. Please contact your wireless provider if you have questions about your text or data plan.

We intend for our messaging practices to comply with applicable law, carrier requirements, and industry standards. We reserve the right to modify or terminate our SMS program or related messaging features at any time.

19. MISCELLANEOUS

These Legal Terms and any policies or operating rules posted by us on the Services constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Legal Terms shall not operate as a waiver of such right or provision. These Legal Terms operate to the fullest extent permissible by law.

We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. If any provision or part of a provision of these Legal Terms is determined to be unlawful, void, or unenforceable, that provision is deemed severable from these Legal Terms and does not affect the validity and enforceability of any remaining provisions.

There is no joint venture, partnership, employment, or agency relationship created between you and us as a result of these Legal Terms or use of the Services. You agree that these Legal Terms will not be construed against us by virtue of having drafted them.

Safety & Requirements

Your safety comes first. Before launch, our team walks you through all operating and navigation details to ensure a confident, stress-free ride.

  • Must be 25+ to rent a tritoon

  • Valid driver’s license and credit card required

  • Waiver must be signed before launch

  • No alcohol consumption by the operator

  • Life jackets must be worn by all passengers under 13, and available for all adults

River Information

While boating on the major rivers of West Virginia, always be alert for large commercial vessels. Large vessels always have the right-of-way because of long stopping distances and blind spots around them. Also, turbulent water around the large vessel could capsize a small boat easily. Stay out of danger zones and restricted areas around locks and dams.

About the Kanawha River

The Kanawha River is Charleston’s signature waterway—a 97-mile stretch formed where the New and Gauley Rivers meet. Flowing gently through the heart of the city, it offers wide, calm waters perfect for boating, paddling, and sightseeing.

From your pontoon, you’ll enjoy scenic views of downtown Charleston, tree-lined banks, and local wildlife like herons and kingfishers. The river features a consistent current and moderate depth, making it ideal for beginners and families who want a relaxing day on the water.

Popular routes include a slow cruise past the Charleston riverfront and out toward the quieter stretches near South Charleston and St. Albans. You’ll pass under historic bridges, spot river barges, and catch the glow of the city skyline reflecting on the water during sunset.

Book Your Ride

Choose your boat, kayak, paddleboard, or hydrobike online. Pick your preferred time — 2, 4, or 6 hours — and we’ll confirm instantly.

At Charleston Riverfront Watersports, we offer two, four and six hour rentals, allowing you to tailor your experience to fit your schedule and desires.

Simply book the boat of your choice and we’ll meet you at the selected drop point and you’re off on the river. When your experience is over, we’ll meet you for pick up. It’s that simple!

We boast a diverse fleet including two luxurious tritoon pontoons, kayaks, stand-up paddle boards and hydro-bikes.

For our tritoon pontoons, we provide the boat with a full tank of gas, and we expect the boat to be returned filled up as well. We recommend filling up here:

We’ll deliver your rental directly to one of our convenient launch sites, including the Charleston Coliseum, Riverfront Levee, Daniel Boone Boat Dock, or Nitro Boat Dock (extra fee applies).

Frequently Asked Questions

Do I need boating experience to rent a boat?

No experience is required! Our crew gives every renter a full walkthrough before departure, including navigation, safety, and operation tips. Within minutes, most guests feel confident and ready to explore.

What’s included in my rental?

How old do I need to be to rent a boat?

You must be 25 years or older with a valid driver’s license and credit card. Guests under 18 must be accompanied by a parent or guardian.

Can I bring food or drinks on the boat?

Absolutely! Coolers, snacks, and non-alcoholic beverages are welcome. Just avoid glass containers and remember—the boat operator must remain sober at all times.

What happens if the weather turns bad?

We monitor local weather and river conditions throughout the day. If unsafe conditions occur (such as storms or high winds), we’ll gladly reschedule your booking or offer a full credit toward a future rental.

How many people can each boat hold?

Our tritoon pontoon boats comfortably seat up to 10 passengers, including the operator. For safety reasons, please do not exceed the posted capacity limit.

Can we swim from the boat?

Yes! You’re welcome to anchor in safe, calm areas away from traffic. Please use caution when entering or exiting the water, and ensure everyone wears a life jacket while swimming.

Where can we go on the Kanawha River?

You can explore miles of scenic waterway—from the Charleston riverfront to quieter stretches near South Charleston and St. Albans. We’ll go over recommended routes and no-wake zones before launch.

What if I need to cancel or reschedule my rental?

Cancellations made 48+ hours in advance receive a full refund. If you need to reschedule within 24–48 hours, we’ll move your booking once at no charge. Same-day cancellations are non-refundable unless weather prevents safe operation.

Do you offer private charters or group events?

Yes! Our tritoons are perfect for birthdays, corporate outings, reunions, and sunset cruises. We can customize your experience with flexible times, scenic routes, and easy setup for decorations or music.
